Privacy policy for recruitment

Introduction

You are seeing this notice because you are on our recruitment page or have been redirected here from the website of an affiliate service provider. This notice sets out how Busha Digital Limited (“Busha”, “We”, “Our”) collects your personal data, how we use or process this information and your rights as a data subject.
We determine how the information we collect from you is used or processed. As such, under the relevant law in Nigeria, we are a data controller. At the moment, we use Bamboo HR for processing job applications. Kindly review their privacy notice here.

One of our numerous obligations under this law is to explain to you in simple terms what information we collect from you, why we collect it, how we collect and what you can do in relation to your information. So, please read further and direct any questions you may have about this notice to us via our Data Protection Officer at compliance@busha.co.
When you complete our application form(s), we collect some information fitting into the following broad categories;
  • Application Account details with our service provider (username, password, log-in data, profile data)
  • Contact details (name, work/institution phone or email, personal phone or email)
  • Education or training related data (Before the application and also if you undertake some form of qualification test during the application/interviewing process.)
  • Past employment and performance related data (job roles or descriptions, performance reviews, length of service, feedback, job title, division, development goals or plans, performance plans).
  • Other recruitment related data (home address, qualifications, resume/CV data, job application data)
We collect these personal data for a wide range of reasons. First, we are required by law to conduct checks and know our employees. These help us properly assess who you are and satisfy ourselves that you are truly who you say you are. We may conduct additional background checks for sensitive positions.

Other reasons include;
  • Verification of the provided data;
  • Reference checks;
  • Assessment of the qualifications and skills needed to perform the job you are applying for;
  • Further communication concerning the recruitment process (e-mails, phone calls, SMS messages, WhatsApp).
We process your personal data on the following lawful basis:
  • Based on your consent; and
  • To comply with any legal requirements regarding employment in Nigeria.
We collect our personal  data from you directly when you fill out our application form(s). You may also complete our application form through third party sites like Indeed and LinkedIn. However, such authorisations are provided by you.
We store your personal data in our offices, on our devices and on cloud-based servers. To protect the confidentiality of your personal data, we utilize reasonable security measures and technologies, such as password protection, encryption, physical locks, etc., Only authorized employees have access to your personal data.  Employees with such authorization have a duty to take the appropriate safeguards to protect such information.

Busha will make reasonable efforts to secure personal data stored or transmitted manually or electronically, from persons who are not authorized to access such information.
Busha will not knowingly disclose, sell, or otherwise distribute your personal data to any third party without your knowledge and, where applicable, your express written permission, except in one of the following instances:
  • Third-party service providers. We may from time to time, outsource certain services, functions, or operations to third-party service providers such as for background checks. When engaging in such outsourcing, it may be necessary for us to disclose your personal data to those service providers. We will, however, to the best of our abilities restrict how these third-party providers access, use and disclose your information.
  • Protection of company and other employees: We may release your personal data when we deem it necessary to comply with the law; enforce or apply our policies and other agreements; or protect the rights, property, or safety of the Company, or other employees.
  • Requirement by law: We may disclose your personal data when such disclosure is reasonably necessary to prevent fraud; comply with any applicable statute, law, rule or regulation; or comply with a court order or regulatory demand based on a law.
You have rights under data protection laws in relation to your Personal Data. You have the right to the following:
  • request access to the Personal Data we have about you and to check that we are lawfully processing it.
  • request correction of any incomplete or inaccurate Personal Data we have, though we may need to verify the accuracy of the new data you provide to us.
  • in specific instances, request erasure of your Personal Data, object to the processing of your Personal Data, or Request restriction of processing your Personal Data
  • Request transfer of your Personal Data to you or a third party.
  • Right to withdraw consent at any time where we are relying on consent to process your Personal Data. However, we do not envisage we will rely on your consent as a lawful basis to process your personal data.
If you believe Busha has breached any of your rights or this policy, please contact us via the details below and we will try and rectify the breach as soon as practicable.

If you believe that Busha is not processing your personal data in accordance with the requirements set out herein or applicable data protection laws, you can at any time lodge a complaint with the regulatory authority, however, we expect that you communicate this with us first.
Where your application is unsuccessful, we will generally proceed to delete your data not later than three (3) years after the date on which it is received in accordance with safety standards and our internal data retention policy.
